Call your ins. co, and let them deal with the legalities of it. My wife was involved in a hit and run a few years ago, called the cops with the plates, and filed an insurance claim. We had to pay the "uninsured motorist/collision" deductible while they followed up with the suit against the guy, but had they won we would have been given a refund of the deductible.

Even if the cops dont help and you dont press charges, it helps with the ins. co. since they know you didnt just hit something and come up with a BS story for your claim.

When I used to live in Oakland CA, the cops did not come unless someone got hurt enough for an ambulance. You were responsible for a tow truck, insurance, the whole bit.
