Default Statue of limitations

To sue someone for an auto accident how long do you have before the statue of limitations kick in.

Does the two years also apply if you were in the back seat of a vehicle that was in a single vehicle accident?

3 years, I only know because when we had to do out continuing education to keep our insurance liscenses this was one of the questions.

Also, even if you switch insurance companies after a year. Your old company would still have to pay out for it if it is within the 3 years
