The only judgements I have made were based solely on your statements in this thread, that YOU posted. You said on the last page " I would've given the cop a piece of my mind" so I took that as you obviously are still feeling as though you were somehow wronged.

Based on circumstance, a cop can have a pretty incredible amount of power on the spot.

The reason for this is because they are supposed to enforce justice for a living, and can sometimes be put in a situation where their life is in danger.

Because of this, they must take precautions to ensure their safety and survival.

When you are in a situation on the other end of this interaction, you might do things that you don't realize are making the officer feel unsafe. I.e. such as digging into a backpack.

This is why he searched your backpack himself. Being that you may have been someone who had just committed a burglary, which is usually committed by someone who is armed with a deadly weapon, he did not want to risk having you reach in and pull out a gun.

For this reason, is why you were handcuffed, just as an extra precaution, to prevent you from fleeing, or fighting in an effective manner.


I understand how you could feel like this was wrong, because you were just innocently riding your bike to go wherever you were going, but you have to think about it from the police officer's point of view. He was just doing his job.

actully from the moment that you are not allowed to leave at your own free will you are under arrest (we just studyed this in my crimanl justice class) but regardless if you report it nothing will come of it because he was doing what he was suppose to and all it will do is piss him off and then he will be looking to bust your balls for every little thing there is

I don't believe that is correct at all. Like I said, I've been cuffed and the officer even stated that I was not under arrest at this time, yet I was not free to leave. He also confiscated my
.380 until the incident was resolved and I was released.

An officer's detention for questioning of a person who calls 911 for assistance does not rise to the level of an arrest, the 9th Circuit Court of Appeals ruled.

The issue in this case is whether investigative "detaining" is equivalent to "arresting."

The defendant claimed her incriminating statements to an officer violated her 4th and 5th Amendment rights because police arrested her without probable cause.

There is no per se rule, the court pointed out, that detention in a patrol car constitutes an arrest.

Furthermore, the court said police can move a suspect from one location to another when there are certain, case-specific circumstances without making an arrest.

The incident began when a woman called police to announce she had "done something bad" and needed an officer to check on her children at her home on a Navajo Indian Reservation in Klagetoh, Ariz.

An officer escorted her in a patrol car and obtained permission to enter the home. After finding the lifeless bodies of three children, the officer secured the scene and questioned the woman as she sat in his patrol car.

First of all everyone that is a nonreading dumbass that keep saying that he was "digging into his backback" STFU and reread the OP. He never had the opportunity to go "digging into his backpack". he was detained before he even had it all the way off his back. so again STFU
I do understand how a cop may feel unsafe in certain situations but I feel that this went way beyond what was "protocol" there is no reason to detain someone for leaving their own neighbourhood. the cop never even asked him where he was coming from or what he was doing before he handcuffed him. and he should have been read his rights as soon as he was handcuffed because technically at that point he is under arrest as stated in previous post.
as for the cop going through your backpack without your consent I feel is wrong but technically he did nothing wrong. I would reccommend putting some sort of lock on your backpack that prevents it from being opened without unlocking it. at that point reguardless of probable cause or not he cannot get into that locked compartment or any other locked compartment without a warrant. Did he unlock your seat and look under it? if so he was in the wrong there
reguardless you got to go on your way so I would let it go. and just tryin to give some advice for any future run-ins

basicly I posted this because I am sick of people not reading and just ASSuming what actually happened and then posting their bullshit remarks to it.
